Step zero: get your medical records
Colombian law gives patients the right to a copy of their complete medical record, the historia clínica. Ask for it before you leave the country: the operative note, anesthesia record, nursing notes, implant identification, imaging, and discharge summary. A clinic is required to provide it. Every path below depends on this document, and it is far easier to obtain in person than from abroad.
The escalation ladder
- The clinic's own complaint process. Every habilitated facility must have a patient complaint mechanism. Put your complaint in writing, in Spanish if possible, with dates and the outcome you want. Many revisions and refunds are resolved here because the clinic's reputation with international patients is worth more than the dispute.
- Supersalud (Superintendencia Nacional de Salud). The national health regulator accepts complaints about healthcare providers, including quality of care and facility licensing. A complaint can trigger an inspection of a facility that operated outside its habilitation.
- SIC (Superintendencia de Industria y Comercio). The consumer protection authority. Relevant when the dispute is about what was promised versus what was delivered, advertising claims, or refunds. Colombia's consumer statute applies to health services sold to consumers.
- Tribunal de Ética Médica. The medical ethics tribunals investigate physician conduct under Law 23 of 1981. They can sanction or suspend a doctor's license. They do not award you money, but a finding supports a civil claim.
- Civil claim for damages. Medical liability in Colombia is generally fault-based: you must show the provider breached the standard of care and that the breach caused the harm. Cases go through Colombian civil courts and take years. Some Colombian attorneys work on contingency-style fee arrangements for strong cases; ask.
Why suing at home rarely works
US and Canadian courts usually decline jurisdiction over a Colombian doctor and clinic for surgery performed in Colombia, on the basis of forum non conveniens and lack of personal jurisdiction. Even if a home court accepted the case, enforcing a judgment against a Colombian defendant requires a Colombian court to recognize it. The practical forum is Colombia. This is not unique to Colombia; it is true of medical tourism everywhere.
What to set up before surgery

- Confirmation, in writing, of the surgeon's ReTHUS registration and the facility's REPS habilitation for the surgery you are having.
- Whether the surgeon or clinic carries professional liability insurance, and the insurer's name. Not all do; the answer is informative.
- Medical complications insurance for travelers. Several insurers sell policies that cover the cost of treating a complication from a planned procedure abroad, including a return trip. They do not pay damages, but they pay for care, which is what you actually need in the first weeks.
- Photos and records of your pre-operative condition, and copies of all consent forms you sign.
Realistic expectations
Most disputes that reach us are about results and revisions, not catastrophic injury, and most are resolved with the clinic directly when the patient has a clear written quote and records. The regulatory complaints exist and work, but slowly. Civil litigation is a multi-year commitment. The best legal strategy is prevention: choose a hospital-based, verifiable surgeon, get everything in writing, and keep every document. Colombia's health system was ranked #1 in the Western Hemisphere and #22 globally in the WHO's 2000 World Health Report; the serious problems come from operators outside that regulated system, which the verification steps above exclude.
